About These Terms

These Terms of Use and Sale (“Terms”) apply to your use of archtechnology.co outside Türkiye and to every ARCH V1 reservation and order shipped outside Türkiye. They are an agreement between you and ARCH Innovation Corp., 8 The Green, STE 23254, Dover, DE 19901, United States (“ARCH”, “we”, “us”).

Orders placed from within Türkiye are sold by ARCH Teknoloji Sanayi ve Ticaret A.Ş. under Turkish consumer law and are governed by the domestic Preliminary Information Form and Distance Sales Agreement instead.

You accept these Terms by ticking the box that refers to them when you place a reservation. Browsing the website does not require you to accept the sale terms in sections 3 to 6. You must be at least 18 years old to place a reservation.

Where We Sell

We currently accept reservations and orders for delivery to addresses in the United States. We intend to open sales to the European Union at a later stage; until terms for that region are published, we do not accept orders for delivery there.

Early Access Reservations

What a Reservation Is

A reservation holds your place in the delivery queue for an ARCH V1. It costs a reservation fee of $100 per unit, paid when you reserve. Reservations are fulfilled in the order in which they were placed.

Price

The price of an ARCH V1 reserved through early access is $999 per unit. The $100 reservation fee counts toward that price, leaving a balance of $899 per unit. The price you see when you reserve is fixed for that reservation: if our price later rises, you still pay $899.

The price does not include local taxes, import duties or customs charges, which are payable by you as described on the Shipping and Returns page.

Delivery Date

ARCH V1 is completing certification testing and a delivery date has not yet been set. We will email you the expected shipping date as soon as it is confirmed. Until then, no delivery date forms part of your reservation.

Balance Payment

Your card details are not stored. When your unit is ready to ship, we will email you a request to pay the $899 balance. Your unit ships after the balance is paid. If the balance is not paid within 30 days of our request, we may cancel the reservation and refund your reservation fee in full.

Cancelling Your Reservation

You may cancel your reservation at any time before you pay the balance, for any reason, by writing to info@archtechnology.co. We refund the reservation fee in full to your original payment method within 14 days of your request. Once the balance is paid, cancellation and returns follow the Shipping and Returns page.

If We Cannot Deliver Within 18 Months

If we have not asked you to pay the balance within 18 months of the date of your reservation, we will refund your reservation fee in full within 14 days, without you having to ask. We will write to you before that date; if you tell us in writing that you want to keep waiting, your reservation continues on these Terms and you may still cancel at any time as described above.

If We Cancel

We may cancel a reservation if we decide not to produce or not to sell ARCH V1 in your country, or if the reservation was placed in breach of these Terms. In that case we refund everything you have paid us for that reservation within 14 days.

Changes to the Product

You may change your color and size preference at any time before your unit ships by writing to us. If the product we are able to deliver differs materially from the description shown when you reserved, we will tell you before asking for the balance and you may cancel for a full refund.

When a Contract Is Formed

Your reservation is accepted when we email you a confirmation of your reservation fee payment. The sale of the device itself is completed when you pay the balance and we confirm that your unit is being prepared for shipping.

Shipping, Returns and Warranty

Shipping, cancellation after balance payment, the 30-day return window, refunds and the two-year limited warranty are set out on our Shipping and Returns page, which forms part of these Terms.

Safe Use

ARCH V1 is a consumer wellness product. It is not a medical device, it is not intended to diagnose, treat, cure or prevent any disease, and its sensor readings are not medical measurements. Use it only as described in its instructions and read the safety information, including when not to use the product and when to consult a doctor before use, which is set out in section 16 of our Privacy Policy.

Use of the Website

Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the website for your own personal, non-commercial purposes.

Restrictions

You may not sell, license or commercially exploit the website or its content; copy, modify or create derivative works from it except as these Terms allow; reverse-engineer any part of it; or use it to build a competing product or service.

Ownership

The website, its content and the ARCH name and marks belong to ARCH or its licensors. These Terms do not transfer any ownership to you.

Feedback

If you send us suggestions or feedback, we may use them freely and without obligation to you. Please do not send us anything you consider confidential.

Changes to the Website

We may change, suspend or discontinue any part of the website at any time.

Privacy and Cookies

How we handle your personal information is described in our Privacy Policy, and our use of cookies in our Cookie Notice. If these Terms and the Privacy Policy conflict on the handling of personal information, the Privacy Policy prevails.

Payments and Third-Party Services

Payments are processed by Stripe, whose own terms and privacy policy apply to the payment. The website links to third-party services such as Kickstarter, Calendly, Instagram and LinkedIn; we are not responsible for those services.

Disclaimer for the Website

The website and its content are provided “as is” and “as available”. To the extent permitted by law, we do not warrant that the website will be uninterrupted or error-free. This section concerns the website only; it does not limit the warranty for ARCH V1 or your statutory rights as a buyer.

Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability to you in connection with a reservation or order is limited to the amount you paid us for it.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under applicable law, and nothing in them affects the two-year limited warranty or your statutory rights.

Changes to These Terms

We may update these Terms. The version in force when you place a reservation applies to that reservation; later changes apply to it only if they are in your favour. We show the date and version at the top of this page.

Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, and the state and federal courts of Delaware have jurisdiction. You may also bring an individual claim in a small claims court where you live, within that court’s limits. Where the mandatory consumer protection law of your place of residence gives you more protection, that protection applies and is not diminished by these Terms.

Before starting a formal claim, please write to info@archtechnology.co; most issues can be settled directly.

General

We communicate with you by email, and these emails satisfy any legal requirement for written notice. These Terms, together with the pages they refer to, are the entire agreement between us about their subject. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. We may transfer our rights and obligations under these Terms to an affiliated company, in which case your rights under them are not reduced.
