Essential Characteristics of the Product

ARCH V1 is a wearable consumer wellness product worn below the knee. By means of micro linear actuators it simulates the mechanical effect of the calf muscle pump, sustaining mechanical movement in the legs during prolonged periods of immobility. It is not a compression device and does not use electrical stimulation.

Sensors on the device take readings of pulse, tissue oxygenation and fluid balance. These readings are used to determine the device’s own activation timing and to display the Buyer’s session data in the application; they provide no health assessment, diagnosis, alert or risk evaluation.

ARCH V1 is not a medical device; it is not intended to diagnose, treat, cure or prevent any disease and is not subject to medical device legislation. Sensor readings are not medical measurements and must not be used as a basis for any diagnostic or treatment decision.

Order Details

All prices are in Turkish Lira and include VAT. The shipping fee is borne by the Seller; no separate shipping charge is collected from the Buyer.

Important Safety Warning: Read Before Purchase

ARCH V1 passes a low-intensity electrical current through the skin by means of a bioimpedance sensor. The following safety warnings therefore apply.

When not to use the product

• Cardiac pacemaker
• Implantable cardioverter defibrillator (ICD)

When to consult a doctor before use

• Use of a neurostimulator (spinal cord or deep brain stimulator)
• Active cancer treatment (areas undergoing local radiotherapy or chemotherapy)
• Suspected acute deep vein thrombosis (DVT)
• Open wound, dermatitis, rash or infection in the area the device will contact
• Pregnancy

The product is intended for users aged 18 and over only.

Payment Details

The payment transaction is carried out through the secure infrastructure of a payment service provider established in Türkiye and operating under the supervision of the Banking Regulation and Supervision Agency. Your credit card details are never seen, recorded or stored by the Seller at any stage.

Instalment payment. Payment by credit card in instalments is available. The available number of instalments varies according to your card issuer and the limits set by legislation, and is displayed at the payment step. In instalment payments the total amount does not exceed the grand total stated above; the Seller applies no additional charge or interest differential due to instalments. Any interest, commission or charges that may be applied by your card issuer are not the responsibility of the Seller and will appear on your card statement.

Delivery

Your order is generally dispatched within 2-5 business days. The statutory maximum delivery period is 30 days.

Shipment is made by the carrier with which the Seller has an agreement. If the carrier has no branch in the Buyer’s location, the product must be collected from the nearest branch notified by the Seller.

The Seller is responsible for any loss or damage that may occur up to the moment the product is delivered to the Buyer. The Buyer must inspect the product on delivery, must not accept a damaged or opened package from the carrier, and must have a report drawn up.

If the Buyer is not present at the delivery address or refuses to take delivery of the product, the Seller shall be deemed to have performed its obligation and any additional shipping costs arising shall be borne by the Buyer.

Right of Withdrawal

The Buyer has the right to withdraw from the agreement within 14 (fourteen) days from the date of taking delivery of the product, without giving any reason and without paying any penalty.

Exercising the Right of Withdrawal

To exercise your right of withdrawal, it is sufficient to give the Seller a clear notice through one of the following methods before the 14-day period expires:

Stating your order number, full name and contact details in your withdrawal notice speeds up the process. You may use the model withdrawal form annexed to this form; its use is not mandatory.

Return Process

You must send the product back to the Seller within 10 days of your withdrawal notice reaching the Seller.

The product must be returned complete and undamaged, together with its box, accessories and any gift items. Ordinary loss of value arising from use is not an obstacle to the return; however, the Seller reserves the right to claim compensation for damage or loss of value caused by the Buyer’s fault.

Return Shipping Cost

Where the right of withdrawal is exercised, the return shipping cost is borne by the Seller. No shipping charge is collected from the Buyer for the return.

After we receive your withdrawal notice, a return shipping code is sent to you. Using this code you can send the product back without any additional payment.

Refund

Within 14 days of your withdrawal notice reaching the Seller, all payments collected are refunded to the Buyer. The refund is made using the same method the Buyer used to pay and without any cost to the Buyer.

For payments made by credit card, the time it takes for the refund to appear on the card account depends on your bank. The Seller has no influence over this period.

Exceptions to the Right of Withdrawal

The exceptions listed in Law No. 6502 and the Regulation on Distance Contracts are reserved. No exception to the right of withdrawal is applied by the Seller for the ARCH V1 product; the product may be returned unconditionally within 14 days.

Warranty

ARCH V1 is warranted against manufacturing and material defects for 2 (two) years from the date of delivery. The scope and conditions of the warranty and the cases falling outside it are set out in detail in the Warranty Certificate delivered with the product.

Misuse, dropping, impact, contact with liquid, intervention by unauthorised persons and use contrary to the user manual fall outside the scope of the warranty.

In the case of defective goods, the optional rights granted by Law No. 6502 (free repair, replacement with a defect-free equivalent, price reduction, rescission of the agreement) are reserved. For returns and exchanges due to defective goods, the shipping cost is borne by the Seller in every case.

Dispute Resolution

For disputes arising from this agreement, within the monetary limits announced each December by the Ministry of Trade:

• For disputes below the monetary limit: the District/Provincial Consumer Arbitration Committee at the Buyer’s place of residence or where the consumer transaction was carried out
• For disputes above the monetary limit: the Consumer Court at the Buyer’s place of residence or where the consumer transaction was carried out

shall have jurisdiction. These rights cannot be restricted by agreement.

Current monetary limits are published on the website of the Ministry of Trade.

Protection of Personal Data

Your personal data is processed within the scope of the Law on the Protection of Personal Data No. 6698, in accordance with the Privacy Notice.

Pursuant to the Tax Procedure Law, your Turkish ID number is requested for the purpose of issuing an e-Archive invoice. This data is processed on the legal basis of compliance with a legal obligation and is retained for the period prescribed by legislation.

Approval

The Buyer accepts and declares that they have read this Preliminary Information Form in its entirety and have been fully informed about the essential characteristics of the product, the sale price including VAT, the payment and delivery conditions, the right of withdrawal, the warranty terms and the means of dispute resolution.
